Correcting the Texas Property Tax Roll - Part I

Accidents sometimes happen. But if they aren't your fault, why would you pay for them? The Texas Property Tax Code makes provisions for clerical and other errors on the tax role and how the chief appraiser or homeowner can submit changes to make the tax role more accurate.

According to section 25.25 of the tax code, the chief appraiser may change the appraisal roll at any time to correct a name or address, a determination of ownership, a description of property, multiple appraisals of a property, or a clerical error or other inaccuracy as prescribed by board rule that does not increase the amount of tax liability.

Section 25.25(c) of the tax code allows for corrections to apply to not only one year, but to the five preceding years. It's important that each homeowner carefully review the appraisal district's records in order to confirm that their data is correct. If you find an error, all you need to do is fill out the proper form.

Specifically, section 25.25(c) states either the chief appraiser or the property owner may make changes in the appraisal roll for any of the five preceding years to correct:
  1. Clerical errors that affect a property owner's liability for a tax imposed in that tax year;
  2. Multiple appraisals of a property in that tax year; or
  3. The inclusion of property that does not exist in the form or at the location described in the appraisal roll.
Don't pay more in taxes than you are legally required. Review your tax statements and appraised value. If you feel there is an error, contact the county appraisal district and make your case known or contact the professionals at O'Connor & Associates to represent you in your county.

There are other remedies available outside of the normal protest process. Watch for our upcoming information about these other items.
